Radon

Problem: Currently, a property owner who has had his building tested for radon, shall provide a buyer-at the time the contract of sale is entered into-with a copy of the results of that test. And, if radon was found, evidence of mitigation or treatment for its removal.

Solution: Licensed home inspectors should be required to advise all homebuyers of the importance of having a radon test. If Trenton believes homebuyers should receive all radon tests, then the State should require testing companies and home inspectors to file reports with a state agency, who in turn would take on the role as information provider to the homebuying public.

Rationale: A property owner should only be required to supply to a homebuyer a relevant radon test. Homeowners and REALTORS® should not be held responsible, nor liable, to a buyer for a report that has no value.
